There Are Many Defenses To Gun Law Violations
Our attorney can employ many strategies to fight on your behalf, including but not limited to:
Unlawful Search & Seizure
The Second Amendment isn't the only law that may work in your favor. Depending on the details of your case, Mr. Trumpler may be able to cite the Fourth Amendment in your defense. The Fourth Amendment – and the Texas Constitution – both prevent unreasonable search and seizure and prevent the use of illegally obtained evidence against a defendant.
Actual Possession
A successful defense can also be mounted around the question of actual possession. The prosecution must prove that you were in possession of the firearm and that you were aware that you had the weapon. Our attorney knows how to call these facts into question. Remember, a criminal conviction requires certainty beyond a reasonable doubt.
Self Defense
Texas Penal Code, Chapter 9, Subchapter C makes clear that individuals have a legal right to utilize force in certain situations. While our laws prohibit the use of force in response to verbal provocation or to resist arrest, the use of a firearm is allowed as part of self defense against an individual in many situations, such as against someone who is illegally attempting to enter your property.
Mr. Trumpler Wins Firearms Cases
Knowing that your attorney has already successfully defended clients from firearms charges can be especially reassuring. Even when the odds seem stacked against a case, Mr. Trumpler has achieved success.
For example, a client recently came to our Austin office after he was charged with aggravated assault with a deadly weapon and obstruction of justice. These charges were filed after the client, a local father, had fired a firearm at his child.
Mr. Trumpler painstakingly reviewed all details of the case and developed a robust defense strategy, effectively arguing that the facts of the situation were not nearly as simple and straightforward as they initially appeared. He spent three days at trial in front of an enlisted panel that returned to the courtroom with a verdict of not guilty.

In 2021, House Bill 1927 was signed into law by Governor Abbott. This changed Texas law by abolishing the requirement for individuals to obtain licenses to carry handguns. This means you can now carry handguns openly or concealed and carry rifles openly in public. If you have been wrongly charged with crimes for behavior that is protected by HB1927, Mr. Trumpler will do everything in his power to clear your name.
Handgun Possession on Private Property
Is Legal in Many Cases
In Texas, the owners of most private property are given the choice as to whether or not they'd like to allow handgun or other firearm possession on their land. If a property owner wants to ban firearms, they must post clear signage or provide advanced notice to guests.
If you were charged in a situation where it was unclear that you were not supposed to possess a firearm, Mr. Trumpler can evaluate all details and potentially argue that there was no way for you to know you were breaking a law.
