For all drug charges, the amount of the controlled substance confiscated by police is determined by aggregate weight, including adulterants or diluents. In addition, potential penalties are automatically increased if a juvenile under 18 years of age was on the premises when the offense was allegedly committed.
The Penalties for Marijuana Distribution
Up to 7 Grams With No Remuneration
Distributing seven grams or less of marijuana without selling it is a misdemeanor punishable by up to 180 days in prison and a maximum fine of $2,000.
Up to 7 Grams
Selling up to seven grams of marijuana is a misdemeanor offense that can be punished with up to a year in prison and a maximum fine of $4,000.
7 Grams to 5 Pounds
Selling this amount of marijuana is a felony that's punishable with 180 days to two years in prison and a maximum fine of $10,000.
5 Pounds to 50 Pounds
Selling between five and 50 pounds of marijuana carries a mandatory minimum sentence of two years in jail and a maximum of 20 years, as well as a fine up to $10,000.
Intent to Sell Charges
If you possess or transport a large quantity of an illicit substance but have not distributed it, you may still be charged with possession with intent to sell. In this case, the court can consider circumstantial evidence, including the presence of paraphernalia, the quantity of on-hand cash, and the frequency of visitors. If the evidence presented is substantially incriminating, the court does not have to prove that you knew of the presence of the illicit substance.
