Maximum Penalties for Distributing a Penalty Group 1 Substance

Substance Amount Category   Maximum Penalty
Less than 1 gram State jail felony 2 years in jail, fine of $10,000
1–4 grams Second-degree felony 20 years in prison, fine of $10,000
4–200 grams First-degree felony Life in prison, fine of $10,000
200–400 grams First-degree felony Life in prison, fine of $100,000
More than 400 grams First-degree felony Life in prison, fine of $250,000

For all drug charges, the amount of the controlled substance confiscated by police is determined by aggregate weight, including adulterants or diluents. In addition, potential penalties are automatically increased if a juvenile under 18 years of age was on the premises when the offense was allegedly committed.

The Penalties for Marijuana Distribution

Marijuana is illegal in Texas, but it is treated differently than the drugs that fall into the four penalty groups. The penalties for drug trafficking marijuana are as follows:

Up to 7 Grams With No Remuneration

Distributing seven grams or less of marijuana without selling it is a misdemeanor punishable by up to 180 days in prison and a maximum fine of $2,000.

Up to 7 Grams

Selling up to seven grams of marijuana is a misdemeanor offense that can be punished with up to a year in prison and a maximum fine of $4,000.

7 Grams to 5 Pounds

Selling this amount of marijuana is a felony that's punishable with 180 days to two years in prison and a maximum fine of $10,000.

5 Pounds to 50 Pounds

Selling between five and 50 pounds of marijuana carries a mandatory minimum sentence of two years in jail and a maximum of 20 years, as well as a fine up to $10,000.

There are even harsher penalties for the sale or delivery of larger amounts of marijuana, with the highest amounts carrying a potential sentence of life in prison. No matter the severity of your drug trafficking charge, our attorney will fiercely defend your freedoms.

Intent to Sell Charges

If you possess or transport a large quantity of an illicit substance but have not distributed it, you may still be charged with possession with intent to sell. In this case, the court can consider circumstantial evidence, including the presence of paraphernalia, the quantity of on-hand cash, and the frequency of visitors. If the evidence presented is substantially incriminating, the court does not have to prove that you knew of the presence of the illicit substance.

Drug trafficking charges are very serious and should be handled with care by a qualified criminal defense attorney to avoid long-term repercussions. Contact our Austin attorney today.
